Driving under the influence of alcohol or drugs is one of the most common type of cases we do at the Conner Law Group. For many of our clients that come in with first DUI arrest, it is the first and only contact that they will ever have with the criminal justice system. An arrest for DUI can have very serious consequences, even as a first offense. You could face a mandatory jail sentence, lose your license for a period of time, and most importantly if convicted of a DUI, even a first offense, it could leave you with a lifetime criminal record.
By hiring a competent DUI attorney, you may be able to avoid some of these pitfalls. For instance, in Pennsylvania, there are diversionary programs. The most popular one is called ARD, which stands for alternative rehabilitation disposition. Under ARD, which is available for first-time DUI offenders, you may be able to avoid jail time and, most importantly, be able to get your criminal record expunged after successful completion of the program.
However, you should be advised that I consider ARD and I often refer to it as your one-time get out of jail card. Once you are accepted into the ARD program, you will not be able to be accepted into that program on any subsequent DUI arrest. Also, you will not be eligible for ARD if you’ve had any prior criminal convictions. Again, if charged, arrested with DUI, your best option is to consult a competent DUI attorney as soon as possible.
