Pennsylvania DUI consequences depend greatly on the blood alcohol content (BAC), scientifically assessed through a breath or chemical test at the time of the stop or detainment. The legal limit in Pennsylvania changed from 0.10% BAC to 0.08% in 2003. There are three general categories of DUI in the state: General Impairment (0.08% to 0.99%, undetermined), High BAC (0.10% to .159%), and Highest BAC (0.16% and higher). Those who refuse to take a breath or chemical test will be subject to the penalties of a Highest BAC.
